Diese Allgemeinen Geschäftsbedingungen (AGB) regeln das Verhältnis zwischen Milocheff Holding GmbH und unseren Kund:innen.
These General Terms and Conditions govern the relationship between Milocheff Holding GmbH and our customers.
1. Geltungsbereich / Scope
Diese AGB gelten für alle Anfragen, Angebote, Verträge und sonstige Rechtsgeschäfte zwischen Milocheff Holding GmbH („Anbieter“) und der/dem Kund:in.
These terms apply to all inquiries, offers, contracts and other legal transactions between Milocheff Holding GmbH and the customer.
2. Vertragsgegenstand / Subject of the contract
Der Anbieter vermietet möblierte Wohnungen in Wien (vorbehaltlich Verfügbarkeit) und bietet optionale Unterstützungsleistungen (z. B. Hilfe bei der Anmeldung, Übersetzung, Alltagskoordination) an.
The provider rents furnished apartments in Vienna (subject to availability) and offers optional support services (e.g. registration assistance, translation, daily coordination).
Wichtig: Wohnung und Unterstützungsleistungen sind voneinander unabhängig. Eine Anmietung der Wohnung ist ohne Buchung von Leistungen möglich.
Important: apartments and services are independent. Renting an apartment does not require booking any services.
3. Vertragsabschluss / Contract formation
Anfragen über die Website stellen kein verbindliches Angebot dar. Ein Vertrag kommt erst durch eine ausdrückliche schriftliche Auftragsbestätigung (z. B. unterzeichneter Mietvertrag, Auftragsbestätigung per E-Mail) zustande.
Inquiries via the website are not binding offers. A contract comes into effect only upon explicit written confirmation (e.g. signed rental agreement, email confirmation).
4. Preise und Zahlung / Prices and payment
Alle Preise verstehen sich, sofern nicht anders ausgewiesen, in Euro inklusive der gesetzlichen Umsatzsteuer. Zahlungsmodalitäten werden im jeweiligen Vertrag oder Angebot geregelt.
All prices are in euro including statutory VAT unless stated otherwise. Payment terms are defined in the respective contract or offer.
5. Rücktrittsrecht für Verbraucher / Right of withdrawal for consumers
Verbraucher:innen im Sinne des Konsumentenschutzgesetzes (KSchG) und des Fern- und Auswärtsgeschäfte-Gesetzes (FAGG) haben bei im Fernabsatz geschlossenen Verträgen über Dienstleistungen das Recht, binnen 14 Tagen ohne Angabe von Gründen vom Vertrag zurückzutreten.
Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) and the Distance and Off-Premises Contracts Act (FAGG) have the right to withdraw from distance service contracts within 14 days without giving any reason.
Die Widerrufsfrist beginnt mit dem Tag des Vertragsabschlusses. Zur Ausübung des Widerrufsrechts genügt eine eindeutige Erklärung (z. B. per E-Mail an office@milocheff.com).
The withdrawal period begins on the day the contract is concluded. To exercise the right of withdrawal, a clear declaration (e.g. by email to the address above) is sufficient.
Bei Mietverträgen über Wohnraum gelten die zwingenden Bestimmungen des Mietrechtsgesetzes (MRG) bzw. ABGB.
For residential lease agreements, the mandatory provisions of the Austrian Tenancy Act (MRG) and Civil Code (ABGB) apply.
6. Leistungserbringung / Service delivery
Unterstützungsleistungen werden in der vereinbarten Form erbracht. Der Anbieter erbringt keine Rechtsberatung, keine offizielle Vertretung gegenüber Behörden und gibt keine Garantien hinsichtlich behördlicher Entscheidungen, Visa-, AMS- oder Genehmigungsverfahren ab.
Support services are delivered as agreed. The provider does not offer legal advice, official representation before authorities, or any guarantees regarding government decisions, visas, AMS, or approval procedures.
7. Haftung / Liability
Der Anbieter haftet nach den gesetzlichen Bestimmungen für Vorsatz und grobe Fahrlässigkeit. Für leichte Fahrlässigkeit haftet der Anbieter nur bei Verletzung wesentlicher Vertragspflichten und nur in Höhe des vorhersehbaren, vertragstypischen Schadens. Eine Haftung für Folgeschäden, entgangenen Gewinn oder mittelbare Schäden ist – soweit gesetzlich zulässig – ausgeschlossen.
The provider is liable under statutory provisions for intent and gross negligence. For slight negligence, liability is limited to breach of essential contractual duties and to the foreseeable, contract-typical damage. Liability for consequential damages, lost profits or indirect damages is excluded to the extent permitted by law.
Bestehende zwingende gesetzliche Haftungsregelungen (z. B. nach dem Produkthaftungsgesetz oder bei Personenschäden) bleiben unberührt.
Mandatory statutory liability rules (e.g. Product Liability Act, personal injury) remain unaffected.
8. Datenschutz / Data protection

9. Anwendbares Recht und Gerichtsstand / Governing law and jurisdiction
Es gilt österreichisches Recht unter Ausschluss des UN-Kaufrechts. Gerichtsstand ist – soweit zulässig – das sachlich zuständige Gericht in Wien, Austria. Zwingende Verbraucherschutzbestimmungen bleiben unberührt.
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is – where legally permitted – the competent court in Wien, Austria. Mandatory consumer protection provisions remain unaffected.
10. Salvatorische Klausel / Severability
Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, so bleibt die Wirksamkeit der übrigen Bestimmungen davon unberührt.
Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall not be affected.
